Regarding the Garcia travesty, a lot of TV commentators are remarking that this is a watershed moment for the Trump Administration. The executive branch has locked horns with the judicial branch and neither side seems willing to budge. We would like to add our two cents worth. Whether you are a Republican or Democrat here’s a tough question: How do you justify the Attorney General of the United States making the claim that Mr. Garcia is a terrorist? He was denied due process; there is NO supportive evidence; and he has a clean criminal record. Imagine Pam Bondi standing before the American people and judging Mr. Garcia without any evidence, due process or suggestive criminal record. Does this sound like Mr. Trump has “weaponized” the Department of Justice to defend his illegal and unnecessary deportation of Mr. Garcia? Ms. Bondi is supposed to be the “top cop” whose duty is to see justice done according to the US Constitution and any precedent case law. But she insists that Mr. Garcia will NEVER be returned. Battle lines are drawn and this is the bend point in our history. Both branches are considered equal but the Executive branch has admitted its failure to protect an individual who has American legal rights. The resolution of this matter will dictate (pun intended) the Trump moves for the rest of his reign. Either he will lose and learn to be more careful when trampling the rule of law; or, he will win and successfully dominate all government decisions without restraint. If the matter goes on long enough we think Mr. Garcia will be killed in his prison. That relieves Trump of having to capitulate to the Supreme Court and it allows the Supreme Court to abdicate its ruling and the orders of at least two other Federal judges. We hope that isn’t the outcome but right now we see no other path to resolution.
