In our continuing discussion over the Trump matter we need to address a central theme of the Jack Smith Indictment. Much is being said about the state of the “defendant’s (Trump) mind”. We hear comments that seem to distinguish between what Trump believed and what he knew. The theory is that if he really believed the election was stolen maybe he isn’t guilty of all the charges. WRONG!!!!!!!!! Think about it…First everyone on his staff, all close advisors, the weight of 62 failed lawsuits, multiple vote recounts and hand-by-hand audits repeatedly proved that this election was not only not stolen–it was the safest, fairest and most secure election in history. Second, his own words show that he had accepted defeat in a variety of contexts. Third–and most telling–is the false impression that his belief matters. Even if Trump thought the election was stolen–that would not give him the right to break numerous Federal laws that are the bedrock of our democracy. The act of obstruction for example doesn’t forgive the “obstructer” if he acted under misinformed circumstances. The act is criminal regardless of the logic employed. Just imagine how the Jan 6 rioters would have fared if they said “we acted under the wrong impression that the election was stolen so we’re not guilty of destroying the US Capitol, injuring hundreds of Capitol police and interfering in a Federal process”. Should they be excused because Trump lied to them and they acted on that false information? Donald Trump’s state of mind cannot be easily proven but his actions are well-documented with E Mails, phone calls, audio tapes, surveillance recordings and corroborating witness testimony. The only way we see him mitigating the charges is by pleading insanity. So far he’s made a very strong case for separation from reality. Come to think of it, maybe the whole GOP could join him in their pathetic attempt to save the Party from total disgrace. Stay tuned to the Indictment proceedings. This event will be a huge part of American history regardless of what follows. (Does anyone else see the irony in the Jan 6 judge and the Georgia Prosecuting Attorney be female? Maybe this isn’t as odd as it appears but we’re wondering what the “Donald” will be thinking as these court appearances play out.)
